Michael Gergen, Counsel (Latham & Watkins)

Michael Gergen is a partner in Latham & Watkins' Washington, D.C. office in the firm’s Finance Department and is a member of the Energy Regulatory and Markets Group and the Project Development and Finance Group. He has extensive experience developing practical applications of economic theory, corporate finance and regulatory law to assist clients in the energy industry and other network industries to compete successfully in an environment of market-based, open-access competition. Mr. Gergen represents entities involved in electric generation and transmission, electric and gas marketing and trading, and investment and commercial banking, as well as foreign governments and financial institutions, on a variety of energy-related matters. Mr. Gergen also assists clients in accessing programs administered by the US Department of Energy (DOE), including the DOE Loan Guarantee Program and other programs under DOE’s Energy Efficiency and Renewable Energy Office, and state energy programs focused on renewable energy and energy efficiency technologies.

Mr. Gergen has assisted clients in the formation and continuing development of wholesale electric power markets and regional transmission entities in the United States, assisted on federal and state regulatory policy issues regarding Smart Grid and energy efficiency technologies, assisted in energy asset acquisitions and divestitures, negotiated energy purchase and sale, transmission and interconnection contracts, litigated contract disputes, and drafted federal, state and foreign energy legislation. He has assisted clients with matters before the Federal Energy Regulatory Commission (FERC), the US Department of Justice (DOJ), the Federal Trade Commission (FTC), the Securities and Exchange Commission (SEC), the Commodity Futures Trading Commission (CFTC), the Surface Transportation Board (STB), the International Chamber of Commerce (ICC), various state regulatory commissions, and numerous federal and state courts concerning ratemaking, trade regulation, antitrust, market regulation and compliance, and general regulatory and commercial matters. Mr. Gergen also has served as an economist for an investor-owned public utility in New England, as well as an economic consultant for a state energy commission in the West.

Mr. Gergen has been cited as a leading energy attorney in the 2006-2011 Chambers USA legal guides. He has given a variety of speeches on energy regulatory and policy matters. He is a member of the Federal Energy Bar Association and the American Bar Association. Mr. Gergen was selected for inclusion in The Best Lawyers in America 2012 as a recommended attorney in Energy Law.
